Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") set forth the terms and conditions for using this service (hereinafter referred to as the "Service"). Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Applicability)

These Terms shall apply to all relationships related to the use of the Service between the User and the Service Operator (hereinafter referred to as the "Operator").

Article 2 (Definitions)

The definitions of terms used in these Terms shall be as follows.

• "Service" means the "Photo Enhancement Service" provided by the Operator.
• "User" means an individual or legal entity that uses the Service.

Article 3 (Registration)

Registration for use shall be completed when an applicant for use of the Service applies for registration by the method prescribed by us and the Operator approves the application.

Article 4 (Prohibited Acts)

Users shall not engage in the following acts when using the Service.

• Acts that violate laws and regulations or public order and morals
• Acts related to criminal activities
• Acts that destroy or interfere with the functions of the Service's server or network
• Acts of collecting or accumulating personal information, etc. about other users
• Acts of using the Service for fraudulent purposes
• Acts of providing benefits directly or indirectly to anti-social forces
• Acts of uploading images containing excessively violent or cruel expressions
• Acts of uploading images containing obscene expressions, child pornography, or adult content
• Acts of uploading images containing illegal items such as weapons, drugs, or counterfeit goods
• Acts of uploading images containing expressions that lead to discrimination based on race, nationality, creed, gender, social status, etc.

Article 5 (Suspension of Service Provision, etc.)

The Operator may suspend or interrupt the provision of all or part of the Service without prior notice to the User if it determines that any of the following grounds exist.

• When performing maintenance checks or updates on the computer system for the Service
• When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters

Article 6 (Attribution of Rights)

All intellectual property rights related to the Service belong to the Operator or those who have granted licenses to the Operator. The copyright of photos uploaded by the User remains with the User, but the User grants the Operator permission to use them to the extent necessary to provide the Service.

Article 7 (Usage Restrictions and Deregistration)

If a User violates any provision of these Terms, the Operator may restrict the User from using the Service or delete the User's registration without prior notice.

Article 8 (Disclaimer of Warranty and Disclaimer of Liability)

The Operator does not expressly or impliedly warrant that the Service is free from factual or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors or bugs, infringement of rights, etc.).

The Operator shall not be liable for any damages incurred by the User arising from the Service, except in cases of intentional or gross negligence by the Operator.

Article 9 (Change of Service Content, etc.)

The Operator may change the content of the Service or discontinue the provision of the Service without notifying the User, and shall not be liable for any damages incurred by the User as a result.

Article 10 (Changes to Terms of Service)

The Operator may change these Terms at any time without notifying the User if it deems it necessary. If a User starts using the Service after a change to these Terms, the User shall be deemed to have agreed to the changed Terms.

Article 11 (Handling of Personal Information)

The Operator shall appropriately handle personal information obtained through the use of the Service in accordance with the Operator's "Privacy Policy".

Article 12 (Notification or Contact)

Notifications or contacts between the User and the Operator shall be made by the method prescribed by the Operator.

Article 13 (Prohibition of Assignment of Rights and Obligations)

Users may not assign their status under the usage contract or rights or obligations based on these Terms to a third party or provide them as collateral without the prior written consent of the Operator.

Article 14 (Governing Law and Jurisdiction)

Japanese law shall be the governing law for the interpretation of these Terms. In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Operator (Tokyo District Court) shall be the exclusive agreed court of jurisdiction.

Article 15 (Geographic Restrictions)

This service does not support access from European Union (EU) member countries. Due to GDPR (General Data Protection Regulation) compliance requirements, we do not accept users from the EU.
